Please be informed that your order will be filled by Piotr Poziomski, operating under the business name "POZIOM" Piotr Poziomski, on the principles set out below in the “Purchase Orders Terms and Conditions”.
Please read the following Terms and Conditions carefully and confirm your acceptance by signing this document or acknowledging your acceptance in another explicit manner.
PURCHASE ORDERS TERMS AND CONDITIONS:
1. Since the goods ordered were made individually and according to the buyer's order, the Buyer is not entitled to withdraw from the contract. The contract is based on the Order of the buyer and is legally binding through this.
2. The subject-matter of the order will be performed in the manner that you describe in the order. Where not described by you, the order will be performed in a manner consistent with market practices generally accepted in Poland.
3. Any ambiguities and inaccuracies contained in or resulting from your order are your responsibility and cannot constitute grounds for complaints or claims against Piotr Poziomski operating under the business name "POZIOM" Piotr Poziomski.
4. Unless expressly agreed otherwise, your general terms and conditions, regulations or other contract templates will not apply to the contract concluded.
5. The sold goods remain the property of Piotr Poziomski, operating under the business name "POZIOM" Piotr Poziomski until the buyer has paid the price in full. The moment the price is paid shall be deemed to be the date on which the bank account of Piotr Poziomski, operating under the business name "POZIOM" Piotr Poziomski is credited.
6. The contract you conclude with Piotr Poziomski operating under the business name "POZIOM" Piotr Poziomski will be governed by the laws of Poland, excluding the provisions of the United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980.
7. Piotr Poziomski, operating under the business name "POZIOM" Piotr Poziomski may pursue all claims arising from this contract before the Polish courts with local jurisdiction over him or before the courts of the country in which the Purchaser has its registered office or branch. The choice of jurisdiction is up to Piotr Poziomski. The Purchaser or the Seller may pursue all claims arising from this contract exclusively before the Polish courts competent for Piotr Poziomski, operating under the business name "POZIOM" Piotr Poziomski.
